To all non-escorts, the loophole into your first amendment rights has been made law and it extends retroactively into the past as far as authorities need it to for prosecution purposes.Yeah no laws apply retroactively. Getting around that would require a constitutional amendment. SESTA/FOSTA’s bad enough without spreading misinformation.(Plus it’ll get struck down by the courts anyway)it’s not misinformation you walnut. this bill literally is written to apply retroactively. it says that platforms can now be held liable for content they hosted that was, at the time, legal.yes, it’s blatantly unconstitutional, but that only matters if and when it is challenged. congress is free to pass whatever completely unconstitutional laws it wants; someone has to actually be prosecuted under it and then take it to court in order to bring a challenge on that basis otherwise it doesn’t matter at all whether it is a consitutional violation or not.and once that happens it still doesn’t matter if the court has been incompetent dickweeds like gorsuch on it who don’t even know any thing about the law in the first place.regardless, in the MEANTIME, while it is still in place, sex workers are going to die. no amount of pedantry is going to change that fact. this law will kill us.HERE’S THE RELEVANT TEXT RE: THE BILL BEING DESIGNED TO APPLY RETROACTIVELY —EFFECTIVE DATE.—The amendments made by this section shall take effect on the date ofthe enactment of this Act, and the amendment made by subsection (a) shall apply regardless ofwhether the conduct alleged occurred, or is alleged to have occurred, before, on, or after suchdate of enactment.The bill is meant to apply retroactively.
